user to comply with all the terms and regulations set forth by 4 States Truck
Parts, Inc. If you as the user do not agree with all terms of this agreement,
you will NOT be allowed to place any orders from this site.
1. General Information - It is the owner's and/or user's responsibility to
determine suitability of a product for any particular use. Check all applicable
industry, trade association, federal, state, and local regulations. Read all
operation instructions and warnings carefully.
2. Specifications - Specifications shown in this catalog are subject to change
without notice.
3. Pricing - Pricing contained in this catalog is subject to change without
notice.
4. Limited Warranty - Four State Trucks, Inc. ("Four State") agrees to repair or
replace any goods determined to be defective in material or workmanship within
thirty (30) days from the date of invoice, provided written notice is given
immediately upon the discovery of such defect and the defective goods are
promptly returned to the place of shipment, all carrying charges prepaid. This
shall not apply to any goods which have been subject to misuse, negligence or
accident, Four State's sole obligation shall be to repair or replace any goods
which are defective. Four State shall not be liable for special, incidental or
consequential damage or delays directly or indirectly resulting from the sale
or use of the defective goods and will make no allowance for repairs or
alterations without its written consent. FOUR STATE HAS MADE NO WARRANTIES THAT
THE GOODS ARE MERCHANTABLE OR FIT FOR ANY PARTICULAR PURPOSE, AND THERE ARE NO
OTHER WARRANTIES, EXPRESSED OR IMPLIED, WHICH EXTEND BEYOND THE DESCRIPTION ON
THE FACE HEREOF. IN NO EVENT WILL THE COMPANY BE LIABLE FOR SPECIAL, INDIRECT
OR CONSEQUENTIAL DAMAGES OR LOSS OF VEHICLE, CARGO OR PROFITS.
5. Eligibility to place an order - Our services are available ONLY to
individuals who can form legally binding contracts under applicable law.
Without limiting the foregoing, our services are not available to minors. If
you do not qualify, please do not use our services.
6. Buying - As a user of this site you are obligated to complete the
transaction. Orders will be deemed as a legally binding contract except in
exceptional circumstances such as the seller materially changing the
description of the item after the order has been placed.
7. System Integrity - You may not use any device, software or routine to
interfere or attempt to interfere with the proper working of this site. You may
not take any action, which imposes an unreasonable or disproportionately large
load on our infrastructure.
8. Breach - We may immediately issue a warning, temporarily suspend,
indefinitely suspend or terminate your ability to order if you breach this
agreement or if we are unable to verify or authenticate any information, you
provide to us.
9. Limit of Liability - IN NO EVENT SHALL WE OR OUR SITE PROVIDERS BE LIABLE FOR
LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER
ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THIS
AGREEMENT.
10. Freight - IMS Marketing Services Inc., Partslink (Service Providers) and 4
State Truck Parts (herein called the System) cannot and does not guarantee the
accuracy of the freight quotes provided. The freight quotes that are provided
are estimates based on the size and weight of the shipment. In the event that
you have a dispute, you release the System (and our agents and employees) from
claims, demands and damages (actual and consequential) of every kind and
nature, known and unknown, suspected and unsuspected, disclosed and
undisclosed, arising out of or in any way connected with such disputes.
11. General Compliance with Laws - You shall comply with all applicable laws,
statutes, ordinances and regulations regarding your use of our service and
ordering from this site.
